By using, visiting, or browsing The Journal of the Association for Vascular Access Website ("Website") you accept, without limitation or qualification, these Terms of Use and agree, without limitation, to the terms of AVA Privacy Policy. If you do not agree to these Terms of Use and Privacy Policy, please do not use the services or visit the Website. Acceptance of these Terms of Use constitutes a legal agreement between you and AVA and its affiliates(s).

AVA may at any time revise these Terms of Use. You are bound by any such revisions and should therefore periodically visit this page to determine the then current terms of use and conditions to which you are bound. Your use of the Website after changes are made means that you agree to be bound by the AVA Terms of Use and Privacy Policy as they exist at that time.

Furthermore, by posting any information on this Website, you grant us a nonexclusive, royalty-free, worldwide, perpetual license to display, use, reproduce or modify that information. Any information submitted on the Website is subject to the AVA Privacy Policy , the terms of which are incorporated herein.

Indemnity

You agree to defend, indemnify, and hold harmless AVA, its officers, directors, employees, and agents, from and against any claims, actions, or demands, including, but not limited to, reasonable legal and accounting fees, alleging or resulting from your use of the Website or your breach of these Terms of Use. AVA shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit, or proceeding.

Choice of Law

You agree that any issue or dispute arising out of or in connection with your use of The Journal of the Association for Vascular Access Website, intellectual property, the Terms of Use, the Privacy Policy, or any matter concerning AVA shall be governed by the laws of the United States and the State of Utah. If any provision of the Terms of Use or Privacy Policy is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms of Use or Privacy Policy, which shall remain in full force and effect.

By using the Website, you agree to comply with all applicable laws and regulations, including export and re-export control laws and regulations of the United States. The material provided on the Website is protected by law including, but not limited to, United States copyright and trademark law and international treaties. AVA makes no representation that materials contained in the Website are appropriate or available for use in other locations and access to them from territories where their contents are illegal is prohibited. Those who choose to access the Website from other locations outside the United States do so at their own initiative and are responsible for compliance with applicable local laws.

Privacy Policy

The Association of Vascular Access respects the privacy of our members and guests to our website. To protect your online privacy, AVA has implemented the following policy.

What Information Does AVA Collect?

The data AVA collects from our members or guest accounts is used to provide you with updated information from the association as well as to help us better serve our members. It is our general policy to collect and store only personal information that our members and visitors knowingly provide. If our privacy policies change, we will notify all users by e-mail as well as updates placed on our website.

From General Users. AVA does not collect any personal information from those browsing our website. We may collect aggregate data such as the number of hits per page. Aggregate data will only be used for internal and marketing purposes and do not provide any personally identifying information.

From AVA Members and Other Customers. To gain access to members-only resources and personalization features on avainfo.org, members and other users are asked to sign in with their user name and password. AVA asks users to provide their name, email, address, credentials, employment information, professional license, degree and certifications. Additionally, for some e-mails sent by AVA to its members or other customers, we can collect specific information regarding what the recipient does with that email such as monitor whether a recipient opens the email or clicks through to links provided in the message. AVA only uses this information to enhance its products and distribution of those products to members and other customers. This information is not sold or distributed. 

How Does AVA Use Data Collected?

AVA uses only information that is voluntarily submitted by members and other customers in the following ways:

Member Services and Products. AVA use the data collected to improve its own website content; to respond to customer interests, needs and preferences; and to develop new products and services.

Disclosures to Third Parties. AVA also makes some member profile information available through the online AVA Member Directory to other AVA members. Members may opt out to have their information displayed in the online AVA Member Directory through the preferences section of their profile. AVA often sends emails regarding membership, new products, conference registration, or other services provided by AVA. There is always an unsubscribe link at the bottom of each email that allows the recipient to stop receiving emails from AVA.
