Generative Artificial Intelligence (GenAI) Notification Requirements
Starting January 1, 2025, Assembly Bill 3030 requires any health facility, clinic, or physician's office (including a group practice) to notify their patients when using GenAI to communicate “patient clinical information.” The law, however, exempts from this requirement any communication that is read and reviewed by a licensed or certified human health care provider.
Unless the communication is exempt, a notification that the communication was created by GenAI must be provided to the patient, as follows:
For written physical and digital communications, like letters or emails, the notification shall appear prominently at the beginning of each communication.
For written online communications involving a "chat-based" or other continuous online interaction, the notification shall be prominently displayed throughout the interaction.
For audio communications, including voicemails, the notification shall be provided verbally at the beginning and end of the interaction.
For video communications, the notification shall be prominently displayed throughout the interaction.
This law also requires that patients be provided with clear instructions on how to contact a human health care provider, employee, or other appropriate person.

Medicine Recognized
The Nevada Board of Osteopathic Medicine announces it has been recognized as a Wellbeing First Champion for 2024 by ALL IN: Wellbeing First for Healthcare. As a Wellbeing First Champion, the Board has verified that its licensure applications are free from intrusive and stigmatizing language around mental health care and treatment. Verification that all such language around mental health has been removed is confirmed annually by ALL IN: Wellbeing First for Healthcare, a coalition of leading health care organizations, including the Dr. Lorna Breen Heroes’ Foundation, which works to eliminate barriers for health workers to obtain needed mental health care.

Bill Addressing Sexual Misconduct by Licensees Signed into Law
On Friday, December 20, 2024, Ohio Governor Mike DeWine signed Senate Bill 109 into law. The bill provides more tools to hold licensees who engage in sexual misconduct or sexual crimes accountable and provides increased transparency for patients and complainants.
“This bill represents a major step forward in our ongoing efforts as a state to better protect Ohio patients,” said Governor DeWine. “It increases accountability for doctors, increases transparency for patients and the public, and gives our Medical Board the ability to intervene faster when misconduct is occurring. This bill will empower more people to take action when something is wrong.”
