Recent Researches in Music Online
Terms of Use

Access to and use of Recent Researches in Music Online (RRIMO) is subject to these Terms and Conditions, as defined by A-R Editions, 1600 Aspen Commons, Ste 100, Middleton, WI 53562, USA (“Publisher”). Any use of www.rrimo.com and the content therein (“Website”) constitutes acceptance of these terms.

Subscriptions

Access to Recent Researches in Music Online is provided to libraries and other research institutions (“Subscriber”) through an annual, renewable subscription (“Subscription”). The “Subscription Period” commences on the date of the subscription invoice for 365 days. Invoices for subscription renewals will be automatically issued by Publisher 90 days in advance of the Subscription expiration date. Subscribers with invoices 30 or more days past due shall be considered in arrears and access to Recent Researches in Music Online may be suspended until the account is paid in full.

Content

During the Subscription Period, the following content will be available:

  • RRIMO: Titles published during the Subscription Period, plus older titles published since January 1, 2018, available on the Website.
  • Legacy Collection: Titles published before January 1, 2018, available on the Website. Legacy Collection is an optional add-on feature that requires an active Recent Researches in Music Online subscription.

Subscribers are granted a nontransferable and nonexclusive right to access, receive, disseminate locally, and use the electronic database of the titles included in RRIMO, and the Legacy Collection if selected, during the term of the Subscription Period. Subscribers have perpetual access to all RRIMO titles released during their active Subscription Periods; perpetual access to the Legacy Collection is granted under certain conditions. Copyright

The entire contents of the Recent Researches in Music Online, the Website, and each publication, abstract, and other material available therein, are protected by copyright owned by A-R Editions, Inc., or other copyright holders as specified in printed copyright notices. A-R Editions reserves the right to withhold or remove from the Website any content for which A-R Editions does not hold electronic distribution rights.

Availability

Publisher, either directly or through a partner provider, shall use all reasonable efforts to make content available on a 24-hour basis. If, however, access is suspended or interrupted, or a defect occurs that prevents access, Publisher’s responsibility shall be limited to using all reasonable efforts to restore access as soon as possible.

User Access

Institutional remote access: Subscribers may allow remote access by individuals affiliated with the subscriber, such as faculty, staff, and currently enrolled students (“Authorized Users”) via telecommunications to a valid IP address on a secure computer network of Subscriber. The Subscriber must issue such individuals with a password or other authentication, and the Subscriber’s network must authenticate such individuals located on remote sites at the time of login and periodically thereafter.

Institutional walk-in use: A Subscriber that operates a public or academic library may allow access by persons unaffiliated with the Subscriber only from computer terminals located on the library’s physical premises.

The Subscriber will exercise reasonable efforts to ensure access to, and use of, Recent Researches in Music Online is limited to Authorized Users.

Permitted Use and Prohibitions

Authorized Users may view, download, save, and print Recent Researches in Music Online content from the database for their own noncommercial educational and research use, but may not further disseminate this content in its electronic or printed form without written permission from Publisher. It is strictly prohibited for the Subscribing Institution or Authorized Users to engage in systematic bulk downloading or printing of Recent Researches in Music Online content.

Interlibrary Loan: Using electronic, paper, or intermediated means, Subscribers may fulfill occasional requests from other institutions (Inter-Library Loan, or ILL), so long as the fulfillment is made in compliance with Section 108 of the United States Copyright Law (17 USC §108, “Limitations on exclusive rights: Reproduction by libraries and archives”) and the Guidelines for the Proviso of Subsection 108(2g)(2) prepared by the National Commission on New Technological Uses of Copyrighted Works (CONTU). Whole books, whole chapters, or whole musical works may not be supplied to another institution via interlibrary loan without explicit permission from Publisher.

Electronic reserves: Access to titles in Recent Researches in Music Online through an Institutional Subscriber’s electronic library course reserve system is limited to creation of a link to the online edition. Creation of digital or physical copies for this purpose is prohibited without express written permission from Publisher.

Coursepacks: Access to titles in Recent Researches in Music Online through online course syllabi or instructors’ websites for courses taught at Subscriber institutions is limited to the creation of a link to the online edition. Digital or physical copying of titles for coursepacks is prohibited without express written permission from Publisher.

Subscribers and Authorized Users may not remove or alter copyright notices or other means of identification or disclaimers as they appear in the Recent Researches in Music Online content; systematically make printed or electronic copies of multiple extracts of the Recent Researches in Music Online content for any purpose; display or distribute any part of the Recent Researches in Music Online content on any electronic network, including without limitation the Internet and the World Wide Web; permit anyone who is not an Authorized User to access or use the Recent Researches in Music Online content; use all or any part of the Recent Researches in Music Online content for any commercial purpose.

Publisher reserves the right to withdraw the Subscriber’s access to Recent Researches in Music Online in the event that it reasonably believes that one, some, or all of any portion of the content is being used otherwise than in accordance with these Terms of Use. In such event, Publisher will restore access only when the matter has been satisfactorily resolved.

Disclaimer and Limit of Liability

Recent Researches in Music Online is supplied “as is” without warranty of any kind, express or implied, including, but not limited to, warranties of design, merchantability or fitness of use for a particular purpose. In no event will Publisher or any of their employees, officers, members, agents, or licensors be liable for any special, exemplary, incidental, or consequential damages arising out of the inability to use, or the use of, the Recent Researches in Music Online or the Website, or on any theory of liability arising out of or in connection with the use or performance of Recent Researches in Music Online.

The entire liability of Publisher to the Subscriber or its Authorized Users arising out of any kind of legal claim (whether in contract, tort, by statute or otherwise) in any way connected with the use or inability to use of Recent Researches in Music Online shall be limited to any amount paid for the current Subscription Period.

Publisher Right to Vary These Terms

Publisher reserves the right to revise these Terms of Use from time to time at our discretion. Whenever these Terms of Use are revised, Publisher will inform Subscribers by giving notice that these Terms of Use have been amended and providing the relevant date of such amendment on all written copies.
